Overtime Commission Disputes

According to the law, overtime wages, bonuses, commissions, and deferred income must be paid to employees, and must be paid in full on a timely basis. When employers withhold or fail to pay overtime wages, bonuses, commissions, or deferred income to employees, they may be subject to legal action from the employee. Employees who are involved in overtime disputes or commission disputes have the legal right to file a lawsuit to recover compensation from their employers and should never tolerate an employer’s failure to pay.

Retaliation

Workplace and/or employment retaliation are terms that refer to when an employee chooses to exercise his/her legal and civil rights. In cases involving overtime disputes or commission disputes, an employee may retaliate by filing a lawsuit to recover payment that he/she has earned from his/her employer. Additionally, an employee may retaliate by reporting an employer to US or State Labor Department. Regardless of the form of retaliation, the ultimate goal is to penalize the employer for his/her misdeed and to retrieve compensation that is owed to the employee or employees.

Exempt vs. Non-Exempt Employees

In the workplace, employees are usually categorized as exempt or non-exempt:

Exempt – an employee who is exempt from the Fair Labor Standards Act (FLSA) and is not entitled to the benefits listed under the FLSA, such as overtime. Typically, exempt employees are salaried, and may earn higher wages.

Non-exempt – an employee is not exempt from the Fair Labor Standards Act (FLSA) and who is entitled to benefits listed under the FLSA. Non-exempt employees are paid overtime if they exceed a 40 hour work week, and are usually paid on an hourly basis.
