Unpaid Wages

After an employee has worked hours at his/her job, it is expected that he/she will receive payment from his/her employer. Usually, the agreement to pay an employee for his/her work is outlined in a written employment contract that is agreed upon and signed by both the employee and employer. Employment contracts are legally binding and must be adhered by to both the employee and the employer. This means that if an employee works for a period of time at an agreed upon wage, the employer must pay the employee for his/her time. Failure to pay the employee is referred to as “unpaid wages”, and can lead to the employee taking legal action against the employer to recover compensation.

Exempt, non-exempt, and contracted employees are all protected by US Employment Laws. When employees are not paid for the work that they do, they have the legal right to seek proper compensation, and may resort to filing a lawsuit against their employers to recover payment. Employees may file lawsuits to recover unpaid wages in various types of situations including, but not limited to:

  • when an employer fails to pay an employee for the full duration of time the employee worked
  • when an employer pays an employee for only a partial amount of the hours the employee actually worked
  • when an employer does not pay the employee on time
  • when an employer does not pay an employee for overtime hours that the employee worked
